AAT Representation & Advice
If your visa or citizenship has been refused or cancelled by the Department of Home Affairs, then you may be eligible to appeal the decision to the Administrative Appeals Tribunal. There are time limits to apply for an AAT review. If you have a successful AAT appeal outcome, then the AAT will generally ask the Department of Home Affairs to reconsider your application. If your review is unsuccessful, then there may be an option to appeal the AAT decision to the Federal Circuit Court or Federal Court, depending on what the issue is. Importantly, the Court cannot make a decision to grant you a visa but rather they can correct a decision of the AAT if it did not follow the law correctly. This would see your matter remitted back to the Department of Home Affairs to reconsider your application. Immigration lawyers are the only professionals permitted to represent you in the federal court system. Registered Migration Agents cannot represent you in the federal court system.
